Death Sentence : Ajmal Kasab vs Afzal Guru

Although people like you and me believe in direct action instead of hearings and court process for KASAB , all we are left with reading news papers and expressing our thoughts in comments.

Yesterday Supreme Court confirms Ajmal Kasab’s Death Sentence, The only captured in 26/11 attack in Mumbai. Better late than never. But this case proved to be early hearing for Indian legal culture.

Thanks to a criminal lawyer Ujjwal Nikam who did good job. Now we can hope no more spicy food like Mutton Biryani and Basamati rice for Kasab. Pakistan must have taken the note of this verdict.

Lets see when he will be hanged.

Senior advocate Aman lekhi says Kasab left with narrow window to escape. He still have three options. He can apply for Curative Petition , Mercy Petition and lastly he can challenge refusal of jurisdictional review.


Afzal Guru

Court upheld death sentence for Afzal Guru for carrying out Parliment Attack in 2001. Afzal guru is still living. In 2005 he applied for Mercy. Which is rejected by Home ministry in 2011 only. His mercy plea lies pending with the President.
Home minister Palaniappan Chitambaram cited a queue for time lapse.
Chitambaram said “Guru is at 21 on the list of 22″. Now guess the Kasab’s number.
Why are we jumping guns? ”

Right now Afzal’s is at number 6 on President’s list.


Kasab

Now Kasab can apply review application on technical platform.
If that is rejected he can apply for mercy in front of Governor of Maharastra State.
If that is too rejected he can apply for mercy in front of President of India.

Law doesn’t set time limit for this. But lets see what new President can do with these mercy application and in what time frame.
We can only hope to see good Political will and execution should be early.
